This Appendix is the part of Extraordinary Writ of Mandamus addressed to
the Highest Authority, the Highest Court - the Appeal Court for the
Federal Circuit and to American Nation to stop the Acts of Treason
committed by Federal Judge Mary Ellen Coster Williams.

The Bush.s Administrations, which are the members of the band of Super
Rich Owners of American Oil Corporations and Military Industrial Complex
and Criminal Group of American Government Officials [Secret Organization
of Traitors in America (SOTA)] declared War of annihilation against
Population of the United States of America.
The Bush.s Administrations, Federal Judges and the others Members of
SOTA facilitated the completely destruction of the Economy, Law and
Order in the Country, physically castrated American working Male
Population, who lost their jobs and became unable to provide any more
for their Families, and mentally annihilated People, destroyed Family
Structures and left Millions Men, Women and Families in desperation and
poverty and Millions of Children Fatherless.
This War on annihilation of American Nation has a name - Treason.
.Treason against the United States shall consist only in levying War
against them, or in adhering to their Enemies, giving them Aid and
Comfort.. Article III, Section 8, The Constitution of the United States.
American Citizens cannot rely on the Court System any more.
It does not matter, if You are White, Black, Yellow or Green color,
Protestant, Catholic, Jew, Muslim, Seven Day Adventist or Buddhist, if
you are not a member of the Criminal Group of the Extremely Rich Thieves
protected by the Federal Judges, You are robbed just in the same way -
no discrimination.
The Democracy in America was the envy of the World. No more we are able
to live in the Law-abiding Society, elect Our Government, The President,
The Governors, The Senator, and The Congressmen to run our Country
according to the Constitution and Laws of the United States.
There are no Constitution or Laws enforced any more by the Dictatorial
Regime of the Government Officials, who illegally and criminally
obtained positions in our Government, as U.S. President, and illegal
criminals installed by him, as the Heads of the Department of Justice,
Labor, Treasury, Health and Human Services etc., Judges and Clerks of
Federal Courts, Heads of Securities and Exchange Commission and in the
Rest of American Institutions, which was originally created for one
purpose and only to oversee that American People Constitutional Rights
are enforced.
The United States Justice System does not exist any more. The members of
SOTA Traitors, the Federal Judges are forcing the American People to
spend countless years in Courts in hope that Plaintiffs will become
sick, die or unable to continue their Lawsuits against members of SOTA.
If by some chance, some honest Judge left make Judgment for the Common
People, such Judgment will never be enforced by the Department of
Justice, which is completely under control of members of SOTA.
What is for the American People left to do?
The Declaration of Independence. (July 4, 1776.) is demanding, .that
whenever any Form of Government becomes destructive of these Ends, it is
the Right of the People to alter or to abolish it, and to institute new
Government..
According to .The Declaration of Independence., it is Holy duty and
Obligation of every American Patriots and American War Veterans to
organize Militia and arm themselves to abolish such Government like it
was done in 1776.
It is our Constitutional right to organize .A well regulated Militia
(National Guards), being necessary to the security of a Free State, the
right of the people to keep and bear Arms, shall not be infringed..

to be taken from them by force.
The National Guard units and U.S. Army should come back to the United
States, where it has really belonged, and join the Militia in the States.

General George Washington, or War Hero General Dwight Eisenhower are
desperately needed for American Nation to become in Charge of our joint
American War Veterans-Militia-Military Units, whose Oath to Protect and

of Criminals, Traitors and Thieves, who overtook our Government,
Judicial System and Economy of the United States; uncontrolled
destruction of the Economy of the United States; the gargantuan,

as Exxon, Enron and members of SOTA.
The real War against Terrorism has to be conducted against Thieves and
Bandits by arresting immediately All the present members of SOTA in the
United States Government, Corrupted Federal Judges, Senators,
Representatives, anybody, who allowed robbery of American Citizens.
This is a way our Soldiers will serve the best our Citizens, instead of
fighting the Wars against innocent civilians for the benefits of the
Criminals, who illegally took control over our Country and, who are
robbing the people of the United States of America.
The joint American War Veterans-Militia-Military Units have to declare
Marshal Law: close Airports, Sea Ports and Boarders for period of three
months to prevent Criminals escape; take over the Media - Radio and
Television Stations and Newspaper, who stop reporting any News many
years ago and became a part of Propaganda Machine wholly Owned by the
members of SOTA to fool and prevent American People to get access to the
real News in the World; arrest every member of the Secret Organization
of Traitors in America (SOTA) consisted of Criminal American Government
Officials; Band of Super Rich Owners of American Oil Corporations and
Military Industrial Complex; CEO and Members of the Board of Directors
of the Public Corporations; Employees of the Securities and Exchange
Commission; every Federal, State and Local Judge, who turned the Law
inside out and made illegality legal; anybody who helped Criminals to

pay the extortions fines for traffic or parking tickets, and any other
harassments by police in order to illegally obtain money from
population; who were illegally arrested by the States or City Thugs for
refusing to freely give up their property-House or Car to the criminals;
who were arrested for refusal to pay extortion Tax created by local
criminal without any Constitutional Right to do so; who were illegally
arrested for refusal to provide slaves labor, to be forced to work
without the Union Contract; who were arrested because they exercise
their Constitutional Right by demonstrating against System created by
Criminals from SOTA, who stole their Jobs, their money deposited in
Bank.s Accounts, left families without food and any means to survive,
without any Medical Care, force them to serve and die in illegal War and
bankroll such crime by public money, etc.; who were arrested because
they resisted the search or arrest which were illegal to do, to start

legitimacy for the arrests; who were arrested because they are single
mothers for which Bandits in the Government refused to provide child
care services and who cannot afford to pay for it, so they forced by
Government to leave children for themselves during the time mothers were
trying to earn enough money to feed the children and for that Nobel
attempt to survive, the Bandits in the Government incarcerated the
Mothers accusing them in abandoning of her children and children sent to
expensive Foster homes, which cost 3 times more than to provide Mother
with Child care - the real terrorism of the Government against the
poorest of the population, which is opposite of the real purpose for
which Tax is collected and existence of our Government.
The joint American War Veterans-Militia-Military Units have to replace
the 4 million vacant places in Prisons with the Thieves and Killers
member of SOTA, who have to be incarcerated for Treason and crimes
against People, the Country and National Interests of the United States.
Allow Honest Reporter to report real News from the United States and

the private Accounts and properties of the Thieves and their Accomplices.
Such Court have to determine, who are the Thieves and Robbers of the
People.s Money and responsible for destruction of the Country Industrial
Base, who from the members of the Our present Government and Military
Leaders are Guilty of Treason, who are responsible for devastation,
destruction and of lives and death of Millions of American Citizens, and
punish Guilty to the full extend of the Law including Death Sentence and
completely expropriate from the People found Guilty all the illegally
obtained assets and property.
The Democratic Country cannot exist without elected Government and
enforced Constitutional Law.
Our Constitution is the best what our Forefathers were able to come up
with 230 years ago. World changed and we should make changes the way
Government Elected and operated, so we would not have the Dictators again.
1. We propose to change Senate (made after British House of Lords, which
even British abolished recently) and House of Representatives (made
after House of Commons) and replace it with only one House of People
Deputies directly elected by Citizens of the United States.
Each Deputy should be elected by direct vote of people eligible to Vote
from 1,000,000 persons of the American Population for 6 years without
right to be reelected and every 2 years Third of the House of People
Deputies on revolving basis should be replaced by new Deputies Elected.
2. Any other Elected Official should be Elected for one 5 years Term only.
The President and Attorney General of the United States, State
Governors, City.s Mayors, Sheriffs etc. should be elected by direct vote
of the People eligible to Vote from the American Population.
The elections of all Officials should be conducted in two stages. In
first stage every candidate will get, as many votes as, he can and, then
two Candidates with most Votes will proceed to the Second part of the
Election held by two Candidate, where Candidate with majority Votes will
become President of The United States of America and his opponent will
become Vice President (the same applied to the Attorney General and his
Vice Attorney General).
In the event of equal or close Votes within 0.1%, the Deputies of the
House of Deputies with Third of newly elected Deputies should cast the
Votes to elect next President.
In event of equal or close Votes within 0.1% of State Governor and State
Attorney General, the Deputies elected from that States should vote for
the next Governor, Vice Governor and Attorney General and Assistant
Attorney General of the State, People Deputy, etc.
No elected official can be re-elected to the same position in the
government twice, but have the right to be elected to any position
she/he was not held prior.
Each Candidate for Public Office will be provided with equal time on
Local or National Radio and Television and provided with equal space in
the Local or National Newspapers free of charge, to allow Candidate
advertise his accomplishments in the Public Life, which benefited the
people he intend to represent and his proposal to benefit people.s future.
The Personal life of the Candidates, including their Religion
affiliations and believes, have nothing to do with what this person
intend to do to improve lives of the People in the Country and should be
forbidden for discussions.
Any Candidate, who intends to use Office to promote his Religious
believes or Hatred, should be disqualified from running for Office
immediately.
3. The Judges should be elected by direct vote of the people eligible to
Vote from 100,000 persons of the American Population for 6 years without
right to be reelected and every 2 years Third of the Judges on revolving
basis should be replaced by newly elected Judges.
Every Judge and every Public Official should give the Oath to act
without any deviation from the Constitution and Laws made by House of
People Deputies. The Deputies have to re-evaluate the existing Laws and
simplify them to get rid of the ones, which have double meaning, or
repetitious, or conflict with the Constitution and cast 2/3 votes to
incorporate the Laws in the new improved Code of Laws. The previous Laws
should be abolished and forbidden to use and no previous Lawsuits should
be quoted instead of the Law.
All trial has to be conducted by presiding Judge with Jury of 12
Citizens, who Judge obligated to instruct on the Laws applicable to this
Lawsuit. The decision of the Court should be based strictly on the
Evidences presented and applicable Constitutional Laws of the United
States.
The Court procedure for the Trial should be completed within 6 month,
followed by swift trial. Office of the Attorney General of the State
should be initiating trials, which protect Citizens. Constitutional
Rights against all the violators, and enforce immediately all the
Judgments made by the Courts.
4. There is only One original Constitution exist in the United States of
America since Convention of the American States on September 17, 1787,
where it was presented and ratified to be the Constitution of the United
States.
According to Article VI of The Constitution
.This Constitution and the Laws of the United States, which shall be
made, . shall be supreme Law of the Land, and judges in every State
shall be bound thereby, any Thing in the Constitution or Law of any
State to the Contrary notwithstanding.
The Senators and Representatives (New presently Elected Public
Officials) ., and all executive and judicial Officers . shall be bound
by Oath or Affirmation, to support this Constitution..
All the Elected District Judges have to make decision based only on the
Laws and Constitution of the United States.
The City, Municipals and States Laws and Constitutions were replaced by
The Constitution of the United States and Federal Laws on September 17,
1787 and all elected official and Judges gave the Oath or Affirmation to
this fact. Therefore, to continue use of Local .Law. is the usurpation
of Power and betrayal of the Oath and anybody, who is attempting to used
such Local .Laws. have to be punished by imprisonment.
5. The People Deputies should appoint 5 People from Scientific and
Education Community, who do not have the Shares of this Public
Corporation for the term of 5 years to be the Directors of this
Corporation, who is obligated to oversee the Company progress an the
honest distribution of the Income to the Shareholders.
6. Every American Citizen has to pay 10% Tax on the income without any
exclusions or deductions.
7. Public and Private Corporation shall pay 10% Tax on its Gross
receipts without any exemption..
The Public Corporation should be allowed to use 50% of its Profit, as
the monetary reserve of the Corporation to do Business, and the other
50% should be distributed to the Shareholders every year.
Every Public Corporations registered in the USA, or selling shares on
American.s Stock Exchanges obligated to sell their manufactured product
or provide Services to the People in the United States only with product
manufactured in the U.S. and provide services to American People by
People living in the United States to guarantee jobs for American Citizens.
The Foreign Factories of the American Corporation will not be allowed to
bring their manufactured product into the United States to take jobs
from workers in America. (Europe and Japan have the same Laws).
The Foreign Factories of the American Corporation should sell their
products outside of the United States to compete on Foreign Markets.
The Import from the others Countries should be allowed to sell freely in
the United States after it Taxed equal to the difference in the Cost of
Labor, which will make such Goods competitive with the same Product
Manufactured in the United States. (Healthy and honest competition.)
8. We propose the uniform Sales Tax of 5% on any purchases by private
individuals made in the United States..
9. The Inheritance Tax of 50% on all the property of Rich People after
their death should be restored immediately, because it was designed to
prevent Any Individual or small Group of the Super Rich Individuals to
become richer than the County itself and be able to control the rest of
the Country Population by the power of their money.
The Tax generated by Our Proposals will be more than enough to pay to
Municipalities to improve our Cities, pay for Schools, Pensions,
Disabilities Benefits, Comprehensive Medical Care, the Government
Insurance, Defense of our Country and even generate surplus, as U.S.
Treasury Reserve.
10. The practice in which Criminal conspirators of Judges, Lawyers,
Insurance Companies engaged today with silent approval of Criminals in
the Department of Justice of waiting for 5-6 years for insured Person to
die without any help or money in hope that severity of injured will kill
her/him to prevent to pay Insurance Premium is absolutely
unconstitutional and crime against Humanity.
The People, who were able to survive without any help or compensation
for 5-6 years eventually will get compensation, which not based on needs
of the Person, but instead on Amount, which Lawyer want to be paid for
his role in the Conspiracy against injured Person (1/3 of the Award).
In 99.9% of the cases the Compensation injured Persons received will
sustain her/him for a few years and then, she/he will be forced to beg

The present Insurance System, which operated with help of Criminals in

Therefore, We propose to replace all Insurances with only one Government
Insurance, which will provide you with needed medical care and with lump
sum of money immediately according to your injury to accommodate you
living condition, which will allow you to adjust to new situation and
pay you 80% of the average Salary in the country until you recover.
The same Benefit 80% of the average Salary in the country should be paid
to anybody, who unable to work because of disability, Retired, or became
Unemployed.
The unemployed Person entitled to look for new job for the first 6
months and then have to accept retraining or placement on any Job, which
Government will find or create for her/him at a salary equal to
prevailing wage in for such position in the industry.
It is much better for society at large and for the People to work and
getting pay, than to be unemployed, even if the work has to be
subsidized by the Government.
The Government should provide none Fault Car Insurance with $500
deductible to discourage the false claims and the others forms of
Insurances, such as it exist today, Medical, Dental, Life, House, etc...
We are only country in the World, where health of our people is the
subject to enrichment of all type of devils. Our Doctors are forced to
be in Business to keep the person Sick forever, instead of preventing
People from becoming sick and cure the Patients. Only such attitude to
keep Patients Sick and in needs to visit Doctor forever, guaranteed the
Doctor success in Medical Practice and ability to Pay Malpractice
Insurance to stay in Business.
Doctor is a profession and, when its becomes a business of making money
on keeping people sick, it is nothing but a crime.
We should follow examples of Canada, the European Union or even Mexico
to provide preventative and curing medical care to all population of the
USA.
Doctors should be paid good salaries for Professional Service to the
public. Doctor should not pay malpractice insurance and should not be
taken to Civil Court for money Demands. There is a Criminal Court for
the intentional crime, which obligated to punish every criminal,
including the crime perpetrated by Doctors..
The Government Insurance obligated take care of the accident by lump sum
of money and Disability Benefit, if necessary.
Doctors should be evaluated periodically by Government Medical Board
punished for malpractice, worn, or even deny License to work in his
profession, if necessary.
10. THE CONSTITUTION OF THE UNITED STATES CREATED THE GOVERNMENT AND
ALLOW THE GOVERNMENT TO COLLECT TAX TO SPEND IT ONLY FOR THE FOLLOWING

Government. Who need to create and risk his money in Business, when
working for the Government, the Members of SOTA can rob population for,

these Traitors and Bloodsuckers deserve to be judged and executed and
all the money they and their Families have should be expropriated and
return to the United States Treasury to benefit the People of the Country.
We intend to restore our Country from Feudal Society of Citizens
enslaved by insurmountable debt to the Democratic Capitalist Country of
wealthy Citizens with secure Savings in the Banks, who can buy what they
can afford for the money they have.
The House you live in and the Land are Your Properties and cannot be

place to live, place to work, to support yourself, to have .Life,

AFFIDAVIT
This is the Second Extraordinary Writ of Mandamus filed by Plaintiffs in 
the last 3 months and refusal of Judges of the Court of Appeals for the 
Federal Circuit to act immediately made them the accomplice of Judge 
Mary Ellen Coster Williams guilty of betrayal of the Oath and Treason 
against the Country and American People.
For almost a year Judge Mary Ellen Coster Williams preside over 
procedures in the Lawsuit #04-384C permitting Attorney from Department 
of Justice to commit fraud upon the Court by representing Defendant 
without his permission or consent. After such fraud upon the Court by 
Attorney from Department of Justice was exposed by Plaintiffs, who asked 
Court to fulfill its obligation under the Law by issuing Summery or 
Default Judgment, Judge Mary Ellen Coster Williams engaged in criminal 
prejudicial activities of Obstruction of Justice against Plaintiffs and 
was disqualified on November 21, 2004 under Law Title 28 U.S.C. 
.455(b)(1), which is final and irrevocable and cannot be change by any 
illegal Orders from disqualified Judges according to the Law Title 28 
U.S.C. .455(e) [.No judge shall accept from the parties to the 
proceeding a waiver of any ground for disqualification enumerated in 
section 455(b).].
When, instead of removing herself from the Lawsuit #04-384C immediately, 
disqualified Judge Mary Ellen Coster Williams issuing illegal statements 
that .Constitution and Laws of the United States of America has no 
Jurisdiction in her personal Court. in her illegal Orders and Judgments, 
it is the Act of Treason. Judge Mary Ellen Coster Williams betrayed her 
Oath, the Constitution, the Country, the American People and Plaintiffs.
To appeal crime is to recognize the crime legality, therefore, the Act 
of Treason by Judge Mary Ellen Coster Williams cannot be Appealed, it 
can only be punished.
Article III, Section 3 of the Constitution declared that Treason 
punishable during the life of the Person. (There is no time limitation.)
The honest Judges of the Court of Appeals obligated by the Constitution 
of the United States to determine and execute the punishment for Treason 
against Judge Mary Ellen Coster Williams, as a response to the 
Extraordinary Writ of Mandamus filed by Plaintiffs, which is only way to 
act against Government Official accused in Treason.
This Writ of Mandamus can only be filed because the .exceptional 
circumstances to correct a clear abuse of usurpation of judicial power 
by a trial court. in re Clmar, Inc., 854 F. 2d 461, 454 (Fed, Cir. 1988) 
and, because, as a result of crimes in the trial Courts, Petitioners 
.have no other means of attaining the relief desired. Mallard v. U.S. 
Dist Court for the Southern Dist. of Iowa, 490 U.S. 296, 309 (1989).
This action having been brought on March 8, 2004 by the filing of the 
Complaint and the .Motion to for leave to proceed in Forma Pauperis. in 
The United States Court of Federal Claims against the United States 
Senator Charles E. Schumer (The United States of America) Defendant by 
accusing him to be a Leader of Criminal Syndicate of Public Officials in 
New York City, who are stealing over $600 Billions of Public money and 
provided Documented prove in details (see Lawsuit #04-384C).
The Complaint was assigned to Judge Mary Ellen Coster Williams by Mr. 
Brian Bishop, The Clerk of the Court on March 10, 2004.
On March 12, 2004 Federal Judge Mary Ellen Coster Williams after reading 
and analyzing Plaintiffs. Complaint, as per Law 28 U.S.C. .1915, issued 
The Order .Good Cause having been shown, for the limited purpose of 
addressing the complaint filed on Match 10, 2004 and request is GRANTED. 
Plaintiff may proceed without being requiring to prepay filing fee.., 
which decide in advance any procedural Defense under Rule 12(b)(1) RCFC 
questioning the Court Jurisdiction over the Case by determining, that 
the Court has Jurisdiction over the Lawsuit and the Lawsuit is not 
Malicious or Frivolous.
By adjudicating and accepting the Complaint #04-384C Federal Judge Mary 
Ellen Coster Williams, which represent the United States Court of 
Federal Claims manifestly, under this section [28 USC .1491(a)(1)] 
determined, that a petition against the United States permitted and 
states a cause of action." Law .1992 Acts. House Report No. 102-1006 and 
Statement by President, see 1992 U.S. Code Cong. and Adm. News. p 3921.
The time to Answer Lawsuit #04-384C is 60 days and expired on May 13, 2004.
By .Motion for enlargement of time. Mr. Matthew P. Reed, Attorney, 
Department of Justice requested the extension of 45 days to obtain and 
file in Court and to deliver the Copy to Plaintiffs of the .FORMAL 
REQUEST FROM SENATOR SCHUMER TO THE DEPARTMENT OF JUSTICE TO REPRESENT 
HIM IN COURT.. Court granted extension of 45 days by Order from May 11, 
2004.
The time to Answer Lawsuit 60 + 45 days in total 105 days expired on 
June 29, 2004.
According to the Law governing work of Department of Justice and the 
Attorney General of the USA, the Department of Justice have the right to 
represent Employee of the Federal Government only after such Employee 
filed .Formal Request asking the Department of Justice to represent Him 
in Court..
The United States Senator Charles Schumer, who is the Attorney himself, 
refused to file the .Formal Request asking the Department of Justice to 
represent Him in Court., any Affidavit permitting anybody to represent 
him in Court and refused to Answer Complaint in any way or form, 
therefore, intentionally entered into the Willful Default in the Lawsuit 
#04-384C.
This refusal made Mr. Douglas K. Mickle, The Attorney from the 
Department of Justice illegal entity in Lawsuit #04-384C, who obtained 
45 days extension from issuing Willful Default Judgment #04-384C by FRAUD.
Therefore, The United States Court of Federal Claims obligated to 
Declare and Enforce Willful Default Judgment #04-384C against The United 
States Government and United States Senator Charles Schumer personally, 
which they entered on May 11, 2004.
The every Judge of the United States obligated to act according to the 
Oath he took before performing the duty of his office: .I, Judge (name) 
do, solemnly swear that I will administer justice without respect to 
person, and , do equal right to poor and to the rich, and that I will 
faithfully and impartially discharge and perform all the duties 
incumbent upon me as Federal Judge under the Constitution and laws of 
the United States. So help me God.. Law Title 28 U.S.C. .453
Instead, Mr. Douglas K. Mickle, The Attorney from the Department of 
Justice, The Clerk of the United States Court of Federal Claims and 
Federal Judge Mary Ellen Coster Williams engaged in conspiracy against 
Plaintiffs defined, as the Obstruction of Justice - Law Title 42 U.S.C. 
.1985(2), Deprivation of Plaintiffs Constitutional Rights - Law Title 42 
U.S.C. 1985 (3), and violation of the First 10 Amendments to the 
Constitution (Bill of Rights), Basic Human Rights and countless other 
U.S. Laws.
Any documents to be accepted in Court have to be filed by Plaintiff or 
Defendant in the Lawsuit, or by their Authorized Representatives, who 
prior to any filing should submit to the Court the Authorization bearing 
original signature of the Litigant he represent.
Mr. Douglas K. Mickle, The Attorney from the Department of Justice is 
not authorized Representative of Senator Charles Schumer and, therefore, 
according to the Law is unknown to the Plaintiffs and to the Court 
entity, who cannot represent Senator Schumer without his consent and 
file any documents on his behalf in the Lawsuit #04-384C.
Therefore, The Clerk of the Court on June 25, 2004 engaged in the 
.Obstruction of Justice. by entered illegal .Motion to Dismiss. in the 
Docket #04-384C, which was created by criminal Mr. Douglass K. Mickle, 
who is the illegal entity to the Lawsuit and whose Motion is fraudulent 
fabrication of the facts of which Mr. Mickle have no knowledge, beside 
such motion, if it would be from Defendant, is time barred because 
Defendant obligated to file such motion prior to entering in the Willful 
Default Judgment #04-384C on May 11, 2004.
In addition, the illegal .Motion to dismiss., which based on Rule 
12(b)(1) RCFC and Rule 12(b)(6) RCFC have no merit or present any facts.
First of all, the Court already fulfill it.s obligation and dismiss any 
objection allowed under Rule 12(b)(1) RCFC by Ordering Plaintiffs to 
proceed in .Forma Pauperis..
Second, the Defense under Rule 12(b)(6) RCFC Court obligated to treat, 
as one for SUMMARY JUDGMENT and disposed of, as provided in Rule 56 RCFC 
such as .Every Motion should contain the Factual representation, ., 
which are personally known to the signatory attorney, will be 
disregarding unless supported by:
a) The witness affidavit or declaration under penalty of perjury, 
pursuant to 28 U.S.C. .1746, attached to the motion or found in the 
pleading in the record - Mr. Douglass K. Mickle failed to provide any 
witness affidavit or sign the declaration under penalty of perjury, 
pursuant to 28 U.S.C. .1746;
b) The transcript of a deposition or of trial testimony - Mr. Douglass 
K. Mickle do not present or have deposition or trial testimony;
c) The testimony of a witness who appears at the hearing on the motion - 
Mr. Douglass K. Mickle had no permeation of Defendant to represent him 
and had no witnesses at all;
d) Any of the other submissions referred to in Rule 56(c) RCFC - Mr. 
Douglass K. Mickle had no other submission acceptable under Rule 56(c) 
RCFC;
e) Any other evidence that would be admissible at trial - Mr. Douglass 
K. Mickle had no other evidence admissible at trial..
Senator Charles Schumer, Defendant refused to be represented by Mr. 
Douglass K. Mickle and, therefore, Mr. Douglass K. Mickle is illegal 
entity, who criminally interfered in Plaintiffs Lawsuit, (Obstruction of 
Justice) and who had no witnesses, no documents and no evidence to 
present that would be admissible at trial, THEREFORE, .THE MOTION TO 
DISSMIS. by Mr. Mickle SHOULD BE DISREGARDED ACCORDING TO RULE 56 RCFC.
Therefore, Plaintiffs file, in addition to the .Willful Default Judgment 
#04-384C. from July 25, 2004, the .Motion for Summary Judgment. from 
July 27, 2004, because Attorney from Department of Justice, who 
criminally interfered in the Lawsuit #04-384C fail to provide any legal 
Document in his illegal, fraudulent .Motion to Dismiss..
In November 2004 bias and prejudicial Judge Nancy B. Firestone, who was 
disqualified from Lawsuit #04-1402C in attempt to subvert Proper Civil 
Procedure to deny Plaintiffs Constitutional Rights for Justice 
intentionally exposed Judge Mary Ellen Cosner Williams to .personal 
knowledge of disputed evidentiary fact concerning the proceeding. Law 
Title 28 U.S.C. .455(b)(1), which forced Plaintiffs to disqualify Judge 
Mary Ellen Coster Williams on November 21, 2004 under Law Title 28 
U.S.C. .455(b)(1), which is final and irrevocable and cannot be change 
by any illegal Orders from disqualified Judges according to the Law 
Title 28 U.S.C. .455(e) [.No judge shall accept from the parties to the

where she can write any Order and be a happy Judge together with all the 
others Napoleons Bonaparte running around.
Any Government Official and You, the Judges of The United States Court 
of Appeals for the Federal Circuit, who have knowledge of .Obstruction 
of Justice. in Federal Court and refused to prevent such .Obstruction of 
Justice. are guilty of the same crimes according to the Laws Title 42 
U.S.C .1985, .1986.
The Federal Judges, Justices and State Judges all over The United States 
are conducting the lawless Kangaroo Court, where the Judgments are made 
based on the Personal testimony of the Judges themselves, which is the 
"Crime of Practice of Law by judge." Law 28 U.S.C. Sec 454, who are 
criminally testifying in Court, as the Witnesses, by introducing as the 
evidence, the unrelated Lawsuits, which were adjudicated sometimes over 
the 100 years ago and which contain no premonition or knowledge about 
the Plaintiffs' Lawsuit at all - this outrageous crime, because the 
person "may not testify to the matter unless evidence is introduced 
sufficient to support a finding that the witness has personal knowledge

Article III, Section I of the Constitution of the United States.
.The judicial Power of the United States, shall be vested in one supreme 
Court, and in such inferior Courts as Congress may from time to time 
ordain and establish..
Article I, Section I of the Constitution of the United States.
.All legislative Powers (Power to make the Laws) herein granted shall be 
vested in a Congress of the united States, which shall consist of a 
Senate and House of Representatives..
Article VI of the Constitution of the United States.
.The Constitution, and the Laws of the United States, . shall be the 
supreme Law of the Land; and the Judges in every State shall be bound 
thereby, any Thing in the Constitution or Laws of any State to the 
Contrary notwithstanding.
The Senators and Representatives before mentioned, . and all executives 
and judicial Officers, both of the United States and of the several 
States, shall be bound by Oath or Affirmation, to support this 
Constitution..
The Congress created specially The United States Court of Federal Claims 
by Law 28 U.S.C. Sec. 1491(a)(1), which, in addition to responsibilities 
to enforce All the Law and Constitution of the United States as 
specified in creation of the Courts in Constitution Articles I, III, VI, 
concentrated and specializing on correction of wrongdoing made by 
Government Officials in order to improve work of the United States 
Government.
Any violation of Law and Constitution of the United States by Government 
Officials can be served better and more efficient in the United States 
Court of Federal Claims than in a District Court of the United States, 
which like any other Court obligated to enforce All the Laws and 
Constitution of the United States.
"(a)(1) The United States Court of Federal Claims shall have 
jurisdiction to render judgment upon any claim against the United States 
founded either upon the Constitution, or Act of Congress ..."
And provide this USCFC with special powers
.(2) To provide an entire remedy and to complete the relief afforded by 
the judgment, the court may, as an incident and collateral to any such 
judgment, issue orders directing restoration to office or position, 
placement in appropriate duty or retirement status, and correction of 
appropriate records, and such orders may be issued to any appropriate 
official of the United States (including Federal Judges)..
Therefore, any person who called himself Judge and who is refusing to 
enforce any Laws of the United States and the Constitution, especially 
Constitutional Amendments 1-10 called .Bill of rights. and 13, 14 etc. 
by declaring that it is not in the Jurisdiction of the personal 
Unconstitutional Court he created is the guilty of Treason against the 
United States and its People, in betrayal of the Oath he gave to protect 
the Constitution of the United States and have to be arrested immediately.
The Constitution demanded to arrest any Person committed Treason against 
American people and the Constitution of the United States including 
Senators, Representative, Judges or any others officers of the United 
States Government - Article I, Section 6 of the Constitution of the 
United States.
Therefore, Petitioners are demanding from the Honest Judges of The 
United States Court of Appeals for The Federal Circuit to enforce Act of 
Congress as per Law Title 28 U.S.C. .2072 Rule 1, 8(d), 54(c), 55(a,b), 
79(a) and Rule 69(a) FRCP and corresponding Rules of RCFC.
1. Law Title 28 U.S.C. .2072 Rule 1 - .Procedure in the United States 
Courts . shall be construed and administered to secure just speedy and 
inexpensive determination of any action..
2. Law Title 28 U.S.C. .2072 Rule 8(d) - .Effect of Failure TO DENY. 
Averments (Plaintiffs accusations in the Complaint #04-1402C) in a 
pleading to which a responsive pleading is required, other than those as 
to the amount of damage, are admitted when not denied in the responsive 
pleading..
3. Law Title 28 U.S.C. .2072 Rule 54(c) - .Demand for Judgment. A 
judgment by default shall not be different in kind from or exceed in 
amount that prayed for in the demand for judgment..
4. Law Title 28 U.S.C. .2072 Rule 55(a,b) -
.(a) When a party against whom a judgment for affirmative relieve is 
sought has failed to plead or otherwise defend as provided by these 
rules and in fact is made to appear by affidavit or otherwise, the clerk 
shall enter the party.s default.
(b) No Judgment by default shall entered unless the claimant establishes 
a claim or right to relieve by evidence satisfactory to the court. The 
party entitled to judgment shall apply to the court therefore..

5. Law Title 28 U.S.C. .2072 Rule 79(a) -
.(a) Civil Docket. The Clerk shall keep a book known as .civil docket. . 
and shall enter therein each civil action to which these Rules are made 
applicable.. [The Clerk of the Court obligated to Sign Judgment as per 
Law Title 28 U.S.C. .2072 Rule 55(a) and enter it in the Civil Docket as 
per this Law Title 28 U.S.C. .2072 Rule 79(a)].
6. Law Title 28 U.S.C. .2072 Rule 69(a) - .Execution. Process to enforce 
a judgment for the payment of money shall be a writ of execution..
Therefore, Plaintiffs are filing this Writ of Mandamus in The United 
States Court of Appeals for Federal Claims, as the Demand, to provide 
Justice to Plaintiffs by enforcing .The Willful Default Judgment in the 
Lawsuit #04-384C USCFC., which determined by the Act of Congress under 
Law Title 28 U.S.C. .2072 Rule 1, 8(d), 54(c), 55(a,b), 79(a) and Rule 
69(a) FRCP and corresponding Rules of RCFC.
There is nothing Criminals in the Government can do to scare Us any 
more. History of the United States is full of examples of organized 
assassination of people, whose protest or disagreed with some branch of 
the United States Government, for example President John Kennedy, his 
brother Robert Kennedy, Malcolm X, Martin Luther King, Countless 
Witnesses of serious Crimes, etc... Very often instead of direct 
assassination the Criminal elements in the United States Government used 
high doze of Radiation, where, as a result, victims dieing in 
antagonizing pain within a year from Cancer.
Medical Autopsy do not measure radiation level of the bones of the 
victims of the Criminal elements in the United States Government, or 
American Solders in Iraq exposed to Radiation. The bones retain 
radioactivity for 100s of years.
Therefore, William Pikulin and Savely Petreykov are requesting American 
People to do the same to the Criminal elements in the United States 
Government, what they did to us in case of our sudden demise or death.
Pay the Compensation for the Crimes you committed,
which are the crimes against Humanity and Genocide.
William Pikulin and Savely Petreykov are addressing this legal Document 
to All Real Patriots of America including Honest Employees left in the 
Courts and Government of the United States.
The bullets and assassinations can kill only few, but there is nothing 
in the World, which can stop the Will and Determination of the Nation to 
restore the Democracy, Justice, Constitution and American Way of Life to 
the People of the United States of America and punish the Bandits.

Statement.
The Extraordinary Writ of Mandamus Misc. # 778 (Lawsuit #04-1402C) was 
filed on November 28, 2004 by Plaintiffs a 5 months ago and refusal of 
the Judges of the Court of Appeals for the Federal Circuit to act 
immediately made Judges of the Court of Appeal for the Federal Circuit 
the accomplices of continues Malicious, Bias, Criminal behavior of Judge 
N. B. Firestone, who was disqualified from Lawsuit #04-1402C based on 
the Law Title 28 U.S.C . 455(b)(1) for engaging in Practice of Law, as 
an Attorney by testifying on behalf and instead of Defendant, than, as a 
Judge, used her own testimony, where she presented the crime perpetrated 
by the Defendants, as rightful deeds, displaying the personal bias made 
malicious, criminal statement - Order without any explanation and even 
waiting for Defendant to present any arguments in its Defense.
In the Lawsuit #04-1402C Plaintiffs accused The Department of Justice 
under Supervision of Mr. John Ashcroft, The Attorney General of the 
United States of America and The Members of The United States Judiciary 
Committee of the Senate in becoming the accomplices and protectors of 
the corrupted Government Officials, who engaged in total destruction of 
the United States Economy and prosperity of the American Nation and its 
People through outright robbery of Public Corporations, The United 
States Treasury, personal property of the United States Citizens through 
illegal acts of Usury and Taxation, and stealing money from future 
income of American People by creating National Deficit and hide all that 
stolen money in foreign accounts.
Plaintiffs provided documented prove in the Lawsuit #04-1402C, that The 
Department of Justice under Supervision of Mr. John Ashcroft, The 
Attorney General of the United States of America and The Members of The 
United States Judiciary Committee of the Senate in order to protect 
themselves and their accomplices - the corrupted Government Officials 
obliterated the Laws and Constitution of the United States of America, 
destroy Judicial System in the United States, made mockery of the Courts 
and Judicial Procedures, force Federal Judges to become dishonest 
connivers engaging in crime to protect Bandits by any means, created 
hysteria of terror by facilitating September 11, 2001 National Tragedy, 
engaging in useless Wars in Afghanistan and Iraq, falsification of 
Presidential and Congressional election results - Usurpation of Power in 
order not to face responsibilities for Crime against American Nation.
There is no Defense can be mounted by Department of Justice against 
undisputed Facts contain in the Lawsuit #04-1402C, and, therefore, 
Department of Justice choose not to respond to the Complaint by any 
means and entered in Willful Default Judgment on November 2, 2004.

The Extraordinary Writ of Mandamus Misc. # 784 (Lawsuit #04-384C) was 
filed on December 20, 2004 by Plaintiffs a 4 months ago and refusal of 
the Judges of the Court of Appeals for the Federal Circuit to act 
immediately made Judges of the Court of Appeal for the Federal Circuit 
the accomplices of continues Malicious, Bias, Criminal behavior of Judge 
Mary Ellen Cosner Williams, who was disqualified from Lawsuit #04-384C 
based on the Law Title 28 U.S.C . 455(b)(1) for betrayal of the Oath and 
Treason against the Country and American People.
This action having been brought on March 8, 2004 by the filing of the 
Lawsuit #04-384C and the .Motion to for leave to proceed in Forma 
Pauperis. in The United States Court of Federal Claims against the 
United States Senator Charles E. Schumer (The United States of America) 
Defendant by accusing him to be a Leader of Criminal Syndicate of Public 
Officials in New York City, who are stealing over $600 Billions of 
Public money and provided Documented prove in details (see Lawsuit 
#04-384C).
For almost a year Judge Mary Ellen Cosner Williams preside over 
procedures in the Lawsuit #04-384C permitting Attorney from Department 
of Justice to commit fraud upon the Court by representing Defendant 
without his permission or consent. After such fraud upon the Court by 
Attorney from Department of Justice was exposed by Plaintiffs, who asked 
Court to fulfill its obligation under the Law by issuing Summery or 
Default Judgment, Judge Mary Ellen Cosner Williams engaged in criminal 
prejudicial activities of .Obstruction of Justice. Laws Title 28 U.S.C. 
.1985, .1986, against Plaintiffs and was disqualified on November 21, 
2004 under Law Title 28 U.S.C. .455(b)(1), which is final and 
irrevocable and cannot be change by any illegal Orders from disqualified 
Judges according to the Law Title 28 U.S.C. .455(e) [.No judge shall 
accept from the parties to the proceeding a waiver of any ground for 
disqualification enumerated in section 455(b).].
Instead of removing herself from the Lawsuit #04-384C immediately, 
disqualified Judge Mary Ellen Coster Williams committed the Act of 
Treason. betrayal of the Oath, the Constitution, the Country, the 
American People and Plaintiffs by issuing illegal Unconstitutional 
Statements, Orders and Judgment by declaring that .the Constitution and 
Laws of the United States of America has no Jurisdiction in her personal 
Court., as a reason to Unconstitutionally dismiss the Lawsuits #04-384C 
and Lawsuit #04-1402C, where she criminally declare herself to be the Judge.

The Court of Appeal can only entertain the Appeal which can present new 
evidence or unintentional mistakes made by Judge in the District Court.
The intentional Crime of: Dismissal of the Laws and Constitution of the 
United States; Predatory animal behavior against Plaintiffs; Betrayal of 
Federal Judge Judicial Duty; Betrayal of the Oath (Laws Title 28 U.S.C. 
. 453); Crime of .Extreme Prejudice. (Law Title 28 U.S.C. . 144); Crime 
of Practice of Law (Law Title 28 U.S.C. . 454) on behalf of the 
Defendant; Intentional crime of .Obstruction of Justice. (Laws 42 U.S.C. 
.. 1985, 1986) - by Disqualified Judge Mary Ellen Cosner Williams [Law 
Title 28 U.S.C. . 455(b)] - ARE THE ACTS OF TREASON, WHICH ARE NOT 
APPEALLABLE, BUT ONLY PUNISHABLE.
To enforce such punishment for TREASON is the first and foremost DUTY of 
any Sworn Officer of the United States Government, as specified in the 
Article III, Section 3 of the Constitution, which demand punishment for 
Treason at any time, as long as, traitor alive. (There is no time 
limitation for Treason.)
The Plaintiffs informed almost 5 months ago on November 21, 2004 the 
Federal Judges of The United States Court of Appeal of The Federal 
Circuit by the Extraordinary Writ of Mandamus about the Act of Treason 
perpetrated by Judge Mary Ellen Coster Williams and it was 
responsibilities of the Federal Judges of the Court of Appeals to Act 
immediately.
Any postponement or refusal to Act on accusation of Treason made Federal 
Judges of the Court the Accomplices of Judge Mary Ellen Cosner Williams 
and GUILTY OF TREASON, as well.
This Writ of Mandamus can only be filed because the .exceptional 
circumstances to correct a clear abuse of usurpation of judicial power 
by a trial court. in re Clmar, Inc., 854 F. 2d 461, 454 (Fed, Cir. 1988) 
and, because, as a result of crimes in the trial Courts, Petitioners 
.have no other means of attaining the relief desired. Mallard v. U.S. 
Dist Court for the Southern Dist. of Iowa, 490 U.S. 296, 309 (1989) such 
as Plaintiffs Lawsuit #04-384C and Lawsuit #04-1402C in the USCFC.
William Pikulin and Savely Petreykov are demanding from Judges MAYER, 
RADER, and DYK to reconsider their attempts not to take 
responsibilities, which Law dictate to the Federal Judges, for making 
decisions demanded in Plaintiffs. Extraordinary Writs #778, 784 of 
Mandamus by setting unconstitutionally Writs aside and refusing to act - 
dishonestly pretending, that the issue can be looked at Appeal.
The Crimes are not the subject to any pleading or Appeals to criminals.
Any Crime and especially the Act of Treason deserve the Punishment.
Petitioners, Plaintiffs are Demanding from Judges MAYER, RADER, and DYK 
to enforce the Constitution of the United States Immediately, or Prepare 
to face responsibility for the Treason, which will be punished by 
American People sooner, than You can imagine.
By declaring in the Note that .this order is not citable as precedent. 
in concocted .PER CURIAM., Circuit Judges MAYER, RADER and DYK publicly 
declared that THEIR DECISION TO PUT ASIDE THE EXTRAORDINARY WRITS OF 
MANDAMUS #778, #784 WITHOUT ANY DECISION OR ANY ACTION DEMANDED BY SUCH 
WRITS IS THE MALISIOUS, BIAS, CRIMINAL, OUTSIDE OF THE LAW AND 
UNCONSTITUTIONAL ACT, THEREFORE, IT .IS NOT CITABLE..
BE THE PEOPLE YOU APPOINTED TO BE - THE JUDGES OF THE FEDERAL COURT AND 
DISPERSE YOU DUTY ACCORDING TO THE CONSTITUTION AND THE OATH YOU 
PUBLICLY GAVE .that I will administer justice without respect to person, 
and do equal right to the poor and rich, and that I will faithfully and 
impartially discharge and perform all the duties incumbent upon me as
